Terms of Service

1. Acceptance of terms

By creating an account or using MyCheckmark — whether through the web app at mycheckmark.com or the iOS application — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

2. Description of service

MyCheckmark is a habit-tracking and personal productivity platform that lets you track daily habits, log workouts, journal monthly notes, view performance analytics, and receive reminders. The service is available as a web app and an iPhone app. Features vary by plan (Trial vs. Pro).

3. Account registration

To use the cloud-synced features of MyCheckmark, you must sign in with a Google or Apple account. You agree to:

• Provide accurate and current information.
• Keep your login credentials secure.
• Notify us immediately at support@mycheckmark.com if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

4. Subscriptions and billing

MyCheckmark offers a free 3-day Trial and a paid Pro plan.

• Trial: Available to all new users at no cost for the first three days. The Trial includes full Pro access during the trial window. No credit card is required to start a Trial.
• Pro (web): Monthly billing is available, and Pro Annual is $2.99/month billed annually through Stripe. Subscriptions renew automatically unless you cancel before the renewal date.
• Pro (iOS): Billed through Apple in-app purchase. Subscription renews automatically. Manage and cancel through your Apple ID in the iOS Settings app.
• Access after cancellation: Your Pro access continues until the end of the current billing period regardless of when you cancel.

5. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the service or its infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the service.
• Use automated tools to scrape, crawl, or extract data from the service without our written permission.
• Upload or transmit content that is harmful, abusive, defamatory, or infringes on the rights of others.
• Interfere with the normal operation of the service or the experience of other users.

6. Your content

You retain full ownership of all habits, journal entries, workout data, and other content you create within MyCheckmark. By storing content in the service, you grant us a limited license to host and display that content solely to provide the service to you. We do not claim ownership of your content and do not share it with third parties except as described in our Privacy Policy.

7. Disclaimers

MyCheckmark is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that data will not be lost.

MyCheckmark is a productivity tool, not a medical or mental health service. Nothing in the app constitutes professional health, fitness, or psychological advice.

8. Limitation of liability

To the fullest extent permitted by applicable law, MyCheckmark and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

You may stop using MyCheckmark and delete your account at any time via Settings → Delete Account. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Governing law

These Terms are governed by the laws of the state of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the courts of Texas.

11. Changes to these terms

We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the app at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes your acceptance of the updated Terms.
